(1.) Non compliance with the order dated 17.1.2018 in S.B. Civil Writ Petition No 1301/2018 is alleged in this petition. The petition in issue was disposed of by the Court with direction to the respondents to consider the case of the petitioner and give her posting on the basis of her merit, if there was a post of Teacher Grade-III (Level-I) lying vacant in District Bharatpur.
(2.) The petitioner's case is that despite there being vacancies for posting on the post of Teacher Grade-III (Level-I) at Zila Parishad, Bharatpur, she has not been granted the benefit despite a representation made pursuant to the Court's dated 17.1.2018.
(3.) Reply to the petition has been filed. It has been submitted that the petitioner has been appointed a Teacher Grade- III (Level-I) in Zila Panshad, Jaisalmer following the recruitment to the said post against the vacancies of 2016. It has been submitted that at the relevant time successful candidates for appointment as Teacher Grade-III (Level-I) were given posting to various Zila Parishads with reference to their merit cum preference. Amongst the successful candidates in the relevant year 2016, the petitioner's merit position was 5329. And in terms of her merit, Jaisalmer being her 14th choice she was posted there. It has been submitted that subsequent to the appointments being made to the post of Teacher Grade-III (Level-I) in various Zila Parishads including Zila Parishad Bharatpur, some of the appointees did not join. Those in the waiting list were thereupon allotted the vacant posts of Teacher Grade-III (Level-I) at Bharatpur. It has been submitted that the petitioner's representation pursuant to the court's order was considered and it was found that on the date the petitioner was appointed as Teacher Grade-III (Level-I) in District Jaisalmer, none less meritorious than her was posted at Zila Parishad Bharatpur. Subsequently with regard to the selections of the year 2016, no vacancy obtains on the post of Teacher Grade-III (Level-I) at Zila Parishad, Bharatpur. The vacancies which may obtain are to be filled in the next recruitment year, for which an advertisement has already been issued.
