JUDGEMENT

(1.) This writ petition has been filed on behalf of the petitioner being aggrieved with the action of the respondent Nos.1 to 5 of constructing the Gram Panchayat Bhawan of Gram Panchayat Kolurathoron at Khasra No.220/1 and 220/2 of village Kolurathoron. The petitioner is demanding that the respondents be directed to construct Gram Panchayat Bhawan of Gram Panchayat Kolurathoron at Khasra No.195/1 of the said village.

(2.) In this writ petition, the petitioner has prayed the following reliefs :-

(3.) Reply to the writ petition has been filed on behalf of the respondents, wherein, it is stated that as a matter of fact, earlier also, a PIL being D.B. Civil Writ Petition No.13596/2017 - Madhu Ram & Anr. Vs. State of Rajasthan & Ors. was preferred before this Court claiming relief that the respondents be directed to construct the Panchayat Bhawan at Khasra No.195/1 of Gram Panchayat Kolurathoron instead of land of Khasra No.220/1 and 220/2, however, the said writ petition came to be dismissed by the Division Bench of this Court on 1.11.2017 while observing that a decision to construct a Panchayat Bhawan on a particular place is purely an administrative decision and no interference therein is required by this Court while invoking the powers under Article 226 of the Constitution of India unless having a definite case of malafides.
