RATAN VERMA Vs. STATE OF RAJASTHAN & ORS

JUDGEMENT

(1.) This writ petition has been filed by the petitioner aggrieved against the order dated 20.9.2017 (Annex.5), whereby, the petitioner, on promotion, has been posted against the post of Child Development Project Officer at Badi Sadri (Chittorgarh).

(2.) Several submissions have made by learned counsel for the petitioner including that the petitioner presently is working at Devgarh (Pratapgarh), which is a tribal area and by the order impugned she has been sent to a non-tribal area, which is contrary to law.

(3.) Further submissions have been made that as the petitioner is due to retire in the month of January, 2019, in view of judgment of this Court in the case of Dr. (Smt.) Pushpa Mehta v. Rajasthan Civil Services Appellate Tribunal & Ors.: 2000(2) WLC (Raj.) 725, the petitioner could not have been sent on transfer.
