JUDGEMENT

(1.) Petitioner has filed this bail application under section 439 of Cr.P.C., 1973

(2.) F.I.R. No. 516/2017 was registered at Police Station Karni Vihar, Jaipur for offence under Section 8/20 of the NDPS Act.

(3.) It is contended by counsel for the petitioner that as per the definition of gaanja given in the NDPS Act, 1985, it is the flowering or fruiting tops of the cannabis plant (excluding the seeds and leaves when not accompanied by the tops).
