JUDGEMENT

(1.) This writ petition has been filed by the petitioner seeking following reliefs:-

It is averred in the writ petition that the respondent No.4- Hanuman Siyag was appointed as Block Coordinator of Jal and Swachchhata Samiti, Block Khinvsar on contractual basis vide order dated 01.06.2016. The respondent No.4 committed several irregularities and pursuant to that complaints had been filed against him and Sub Divisional Officer, Khinvsar constituted an Enquiry Committee of four members headed by Tehsildar Khinvsar. The said Enquiry Committee submitted its report after about four months and acting on the same, the respondent No.4 is removed from the post of Block Coordinator of Jal and Swachchhata Samiti, Block Khinvsar vide order dated 03.01.2018.

The grievance of the petitioner is this that though the respondent No.4 is removed from the post of Block Coordinator of Jal and Swachchhata Samiti, Block Khinvsar, however, no FIR has been lodged against him in relation to the embezzlement of money. It is contended that there is enough evidence available with the administration on the basis of which a criminal prosecution can be launched against the respondent No.4 but the respondent Nos.1 to 3 have not taken any action against the respondent No.4 except removing him from the post of Block Coordinator of Jal and Swachchhata Samiti, Block Khinvsar.
