JUDGEMENT

(1.) Learned counsel for the petitioner at the outset submits that the controversy raised in the instant writ-application stands resolved in view of the adjudication by a co-ordinate Bench of this Court at Principal Seat at Jodhpur in a batch of writ-applications, lead case being S.B. Civil Writ Petition No.5255/2013 (Arun Choudhary & Ors. Vs. State & Ors.) , decided on 11.08.2014, referring to earlier adjudication in the case of Jagdish Prasad Dhaka Vs. State & Ors. (S.B. Civil Writ Petition No.5839/2013) and Shibbi Ram Meena Vs. State & Anr. (S.B. Civil Writ Petition No.18614/2013) observing thus:-

(2.) Issue notice on writ as well as stay application, returnable within three weeks.

(3.) Dr. A.S. Khangarot, Addl. Government Counsel, present in Court, is directed to accept notice on behalf of the Staterespondents and complete his instructions including filing of counter affidavit by the next date.
