MAGARAM Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) The present bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner, who is in custody in relation to F.I.R. No. 137/2017, P.S. Rohat, District Pali, for the offences under Sections 363, 368, 376D, 120B I.P.C. and 5(G) /6, 16/17 of POCSO Act and 3(2) (v) , 3(2) (va) of SC/ST (P.A.) Act.

(2.) Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the challan papers.

(3.) The victim Mst.D upon being examined during investigation under Section 161 Cr.P.C. as well as 164 Cr.P.C. has not levelled any allegation of sexual assault against the petitioner. These allegations are attributed to the co-accused Champa Lal.
