JUDGEMENT

(1.) Despite service, no one has appeared on behalf of the respondent No.1

(2.) The present misc. appeal has been filed against the order dated 10.01.2017 passed by the Commissioner, Workmen Compensation (Jurisdiction District Rajsamand) , Bhilwara in WC Case No.16/2015 whereby the application preferred by the appellant under Order 9 Rule 9 read with Section 151 CPC has been rejected.

(3.) The appellant preferred a claim petition in view of the injuries suffered by him due to the accident occurred on 29.09.2004 while working at the factory premises of the respondent No.1.
