JUDGEMENT

(1.) The case has come upon an application filed by the respondent-Bank in which it is submitted that during pendency of this writ petition certain developments have taken place.

(2.) The respondent-Sriganganagar Kshetriya Gramin Bank is a Regional Rural Bank established under Section 3 of the Regional Rural Bank Act, 1976. Further it is submitted that the sponsor bank of Sriganganagar Kshetriya Gramin Bank was State Bank of Bikaner and Jaipur. Besides Sriganganagar Kshetriya Gramin Bank, two other regional rural banks namely Bikaner Kshetriya Gramin Bank and Marwar Gramin Bank were also sponsored by the State Bank of Bikaner and Jaipur. Vide notification dated 12th June, 2006 the Ministry of Finance, Department of Economic Affairs (Banking Division), Government of India merged all the three regional rural banks sponsored by the State Bank of Bikaner and Jaipur namely Marwar Gramin Bank, Sriganganagar Kshetriya Gramin Bank and Bikaner Khsetriya Gramin Bank. In this case, the deputation order for petitioner was passed by the Sriganganagar Kshetriya Gramin Bank which is not in existence due to amalgamation of three Regional Banks.

(3.) It is submitted by learned counsel for the petitioner that the stay order was granted by this Court upon deputation order dated 24th April, 2004 (Annexure-5) and stay is operating since 2004. Further it is submitted that at the time of filing this writ petition, there was no jurisdiction left with the respondent- Bank to sent petitioner on deputation under the control of other employer. Now due to subsequent developments, the order impugned deserves to be set aside because now as per respondents' application the respondent-Bank is not in existence.
