JUDGEMENT

(1.) Mr.R.N. Mathur, learned counsel is appearing as amicus curiae, Mr.Ankur Rastogi, learned counsel is appearing on behalf of the State and Mr.Deshraj Kalwani, learned counsel is appearing for respondents No.6 and 7.

(2.) This PIL was treated on the basis of a letter written to the Chief Justice of this Court against the inhuman behaviour meted out by school teachers to its students.

(3.) It appears from the reply filed on behalf of the State that a criminal case was lodged against the concerned teacher of the school who happend to be Proprietor of the school for offences under Sections 323 and 341 of the IPC and now upon submission of the charge-sheet, cognizance has been taken and the matter is pending trial. It further appears from the materials on record that the question was also raised before the State Human Rights Commission and the matter was closed in view of pendency of the criminal case. In the reply filed on behalf of the State, it is also stated that the matter is pending enquiry so far as school is concerned at the level of the Directorate of the Education Department.
