JUDGEMENT

(1.) This criminal misc. petition under Sec. 482 Crimial P.C. is directed against the order dated 18.3.2006 passed by Additional Sessions Judge No. 1, Bhilwara Camp at Gangapur (for short the revisional Court' hereinafter), whereby the revision petition filed by the petitioner against the order dated 12.5.2005 passed by Additional Chief Judicial Magistrate, Gangapur (for short the trial Court' hereinafter) dismissing the application filed by the petitioner under Sec. 125 Crimial P.C., was dismissed.

(2.) I have heard learned counsel for the parties. Carefully gone through the orders passed by both the Courts below as also the record of the trial Court.

(3.) It is contended by learned counsel for the petitioner though the petitioner is serving in "Aanganwadi" and earning some amount, yet it cannot be a ground to deny the monthly allowance of maintenance. It is further contended that respondent has contacted second marriage i.e. "Nata Marrige" with one Ram and, therefore, the petitioner has a reasonable and plausible cause not to live with the respondent.
