JUDGEMENT

(1.) Heard.

(2.) In this petition the petitioner prays for quashing the order dated 16th July, 2007 Annx. 4 and further it is prayed that respondents be directed to issue fresh Passport in favour of the petitioner, with correct date of birth . The petitioner's date of birth is 20th August, 1976. As per the educational and other legal documents annexed as Anx.2.

The main contention of the petitioner is that at the time of preparation of the Passport , his date of birth was wrongly entered and thereafter by filing an application and affidavit it was prayed by the petitioner that in the passport his date of birth may be corrected as 20th of October, 1976 and delete the date of birth mentioned in the Passport as 20th of October, 1975. The representation of the petitioner was considered and it was informed to the petitioner, in pursuance of his application that he shall furnish the original copy of the declaratory order issued by the first class Judicial Magistrate for change in the date of birth and place of birth. The petitioner's contention is that as per his educational documents, which was issued on 14th of June, 1986 prior to issuance of Passport, his correct date of birth is mentioned as 20th of October, 1976. Along with the affidavit, today the petitioner has filed a photo stat certified copy of the said Certificate, along with the Certificate issued by Headmaster, Ishaqiya Sr.Secondary School, Jodhpur.
