JUDGEMENT

(1.) In this case, petitioner has prayed for direction to the respondents to release complete due retiral benefits with immediate effect alongwith interest @ 18% per annum. Further it is prayed that respondents may be directed to release the regular pension to the petitioner after finalizing the last pay drawn in accordance with the service conditions with all consequential benefits. It is also prayed that respondents may be directed to give appropriate selection grade, fixation as per the prevalent pay commission and to pay all allowances and consequential arrears.

(2.) It is submitted by learned counsel for the petitioner that at present petitioner is getting family pension and for grant of other benefits, this writ petition has been filed by the petitioner. The petitioner is also claiming all these benefits for which her husband late Shri Rajan Solanki, who was working under the control of District and Sessions Judge, Karauli It is submitted by learned Dy. Govt. Counsel that petitioner is getting provisional pension and the final pension is still required to be sanctioned by the respondents.

In my opinion, serious disputed question of fact is involved in this case with regard to grant of selection scale and other retiral benefits, therefore, I deem it just and proper to grant liberty to the petitioner to file detailed representation to the respondents by claiming all benefits for which she is legally entitled. Upon filing the said representation, respondents are directed to decided the same within a period of three months from today.
