JUDGEMENT

(1.) Heard learned counsel for the petitioners.

(2.) By way of filing the present writ petition, the petitioners have challenged the order dated 10.9.2007 (Annexure-4) passed by Divisional Irrigation Officer cum Executive Engineer, Gang Canal, North Division, Sri Ganganagar, the order dated 30.11.2007 (Annexure-6) passed by Executive Engineer as well as the order dated 19.2.2008 (Annexure-10) passed by Superintending Engineer, Water Resources Circle, Sri Ganganagar.

The main contention of the learned counsel for the petitioners is that vide Annexure-3 dated 30.3.2007, the sanction was allowed upto 15.2.2008, therefore, the petitioners are very much entitled for water supply. It is also contended by learned counsel for the petitioner that before the appellate authority, an application was filed by the petitioners, which is placed on record as Annexure-9 wherein it was specifically stated that the order Annexure-3 was applicable upto 15.2.2008 and that date is expired. According to the learned counsel for the petitioner at the time of passing the impugned order, the appellate authority has not considered this fact of the matter.
