(1.) Heard at admission stage.
(2.) The accused petitioner was convicted for offence under Sec. 354 Penal Code and sentenced to two months SI and a fine of Rs. 2,000.00 by the learned Judicial Magistrate, Sadul Sahar on 21.7.94. It was further ordered that in case he does not pay the fine, he would undergo simple imprisonment for two months. He preferred an appeal before the learned Sessions Judge, Ganganagar which was ultimately decided by Additional Sessions Judge No. 1, Ganganagar on 23.9.97 by which he upheld the conviction and dismissed the appeal. Therefore, this revision has been filed.
(3.) Learned counsel for the petitioner did not challenge the conviction and he simply submitted that the learned Magistrate or the learned Addl. Sessions Judge did not consider the provisions of Sec. 360 Cr.RC. He prayed that the petitioner should be given the benefit of Probation of Offenders Act.
