MALKEET SINGH Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) The accused petitioner was convicted for offence under Sec. 323, 341 and 354 Penal Code by the learned Judicial Magistrate, Sri Ganganagar vide his judgment dated 16.8.94. The petition was sentenced as follows-

(2.) The accused petitioner preferred an appeal before the learned Sessions Judge which was eventually heard and decided by learned Addl. Sessions Judge No. 1, Sri Ganganagar who dismissed it on 1.10.97.

(3.) Learned counsel for the petitioner did not challenge conviction & submitted that since the accused petitioner is a young boy, he should have been given the benefit under the provisions of Probation of Offenders Act. He has not challenged the conviction of the accused petitioner. Learned PP has no objection.
