JUDGEMENT

(1.) This writ petition has been filed by the petitioner being aggrieved with the resolution passed in the meeting of the Gram Panchayat dated 31.10.2017, whereby no-confidence motion has been passed against the petitioner.

(2.) The petitioner has challenged the said resolution on the ground that the members of the Gram Panchayat have not filed the proposed motion of no-confidence against the petitioner in Form No.1 as provided under Rule 21 of Rajasthan Panchayati Raj Rules, 1996 (herein to referred as 'the Rules of 1996').

(3.) The said contention of the petitioner is without any merit in view of the Section 113 of the Rajasthan Panchayati Raj Act, 1996 (herein to referred as 'the Act of 1994'), which prescribes that no notice under the Act of 1994 shall be invalid on account of defect or omission in the form.
