JUDGEMENT

(1.) The matter comes up for consideration of the application under Section 5 of the Limitation Act to condone the delay of 248 days in filing this criminal appeal. Despite service of notice, none has appeared on behalf of the respondent to oppose the application under Section 5 of the Limitation Act.

(2.) Having considered the averments made in the application, the application under Section 5 of the Limitation Act is allowed. The delay of 248 days in fining this appeal is condoned.

(3.) The matter is finally heard.
