JUDGEMENT

(1.) The petitioner Bhartiya Adarsh Vidhya Mandir Higher Secondary School Society (hereinafter 'the Society') applied to run B.A.B.Ed. And B.Sc. B.Ed. 4 year integrated courses in its Bharti Teachers Training College (hereinafter 'the College'). An application was submitted to Regional Director, Northern Regional Committee, National Council for Teacher Education on 20-5-2015 for running one unit each (50 students) of B.A. B.Sc. integrated course for the year 2017-18. Finding the application of the petitioner society complete in all respects and after ensuring the requisite compliances for recognition NRC, NCTE granted recognition on 2-5-2017 to two units (50 students each) in the B.A. B.Ed. and B.Sc. B.Ed. 4 year integrated course respectively. The State Government on its part on the application made by the petitioner society to run the aforesaid courses at its college for the session 2017-18 vide letter dated 23-5- 2017 granted NOC. The University of Rajasthan after having issued a preliminary NOC on 27-2-2016, vide letter dated 27-4-2017 approved the staff selection to an extent of 16 faculty for the 4 year B.A. B.Ed./ B.Sc. B.Ed. integrated course, comprising of one principal and 15 lecturers including 4 lecturers with a science background to teach B.Sc. B.Ed. students.

However on the University of Rajasthan being finally applied to affiliate the petitioner Society's college i.e. Bharti Teachers Training college, vide provisional affiliation letter dated 10-6-2017 for the session 2017-18, affiliation was limited to only one unit of B.A.B.Ed. four years integrated course.

(3.) The case of the petitioner society is that the NRC, NCTE having granted recognition to its college for B.A.B.Ed. and B.Sc. B.Ed. 4 year integrated course for intake of 100 students and the state government having similarly granted NOC provisional affiliation by the respondent confined to only one unit of B.A.B.Ed 4 year integrated course, more so after it had issued NOC for two units of B.A./ B.Ed. and B.Sc./ B.Ed. (100 students) on 27-2-2016 and approved staff selection of 16 faculty members for the 4 year integrated B.A. B.Ed. and B.Sc. B.Ed. comprising of one principal and
