(1.) The matter comes up on the third stay application. Under challenge is the order dated 29-8-2016 whereby the petitioner institute's affiliation for its four trades by the National Council for Educational Training (NCVT) has been withdrawn. Counsel for the petitioner institute submitted that the impugned order is in breach of the principles of natural justice and even otherwise palpably disproportionate to the alleged infraction of the petitioner institute being allegedly closed on 28-4-2012, a working day as per notified calendar, when a sudden inspection was made by the officers of the Director of Technical Education, Rajasthan. It has been submitted that the allegation of closure of the institute on 28-4-2012 was even otherwise not made out as the faculty was present at the time of inspection by the team in evidence whereof signature of one of member of the inspection team was appended to the attendance register of the faculty members. This fact by itself indicates that the petitioner institute was working on the said date submitted counsel for the petitioner institute.

Ms. Manjeet Kaur, appearing for the NCVT submitted that signature of a member of the inspection team on the attendance register of the faculty is of little probative worth as it does not bear the seal indicating the designation of the signatory. She further submitted that the first counseling for admission into the academic session 2017-18 has already been concluded and the prayer before this court to allow admissions to the petitioner institute through second counseling, which is to commence 29-8-2017 is belated and unwarranted.
