JUDGEMENT

(1.) This Criminal Misc. Petition under Section 482 Cr.P.C. has been filed by the petitioners for quashing the proceedings pending against them before the Judicial Magistrate, Mawali, District Udaipur (hereinafter referred to as 'the trial court') in Criminal Regular Case No.340/2012 for the offences punishable under Sections 467, 468 and 471 IPC. The the trial court vide order dated 8.3.2016 has allowed the parties to compromise for the offence punishable under Section 420 IPC.

(2.) Brief facts of the case are that the complainant respondent No.1 has filed a complaint before the Judicial Magistrate, Mawali while alleging about the forgery in the panchayat record by issuing forged patta and causing loss to him. The trial court took cognizance against the petitioners for the offences punishable under Sections 420, 467, 468 and 471 IPC and the proceedings are pending against them in the trial court.

(3.) During the pendency of the trial, an application was preferred on behalf of the petitioners as well as the respondent No.1 while stating that both the parties have entered into compromise therefore the proceedings pending against the petitioners may be terminated. The trial court vide order dated 8.3.2016 has attested the compromise for the offence punishable under Section 420 IPC and acquitted the petitioners from the aforesaid offence. The present criminal misc. petition has been preferred by the petitioners for quashing the proceedings pending against them for the offences punishable under Sections 467, 468 and 471 IPC.
