JUDGEMENT

(1.) Four accused Kailash Chandra, Vipin Pandey, Pankaj Sharma and Santosh Singh were convicted by the learned Magistrate vide decision dated April 12, 2002. Whereas Vipin Pandey and Santosh Singh were convicted for an offence punishable under Section 394 IPC as also Section 3/25 of the Arms Act, Kailash Chandra and Pankaj Sharma were convicted for the offence punishable under Section 394 IPC. Santosh Singh did not challenge his conviction. Kailash Chandra, Pankaj Sharma and Vipin Pandey challenged the conviction and sentence imposed. Vide judgment dated 17.09.2003 the appeal filed by three was dismissed and conviction and sentence imposed by the learned Magistrate was upheld.

(2.) For the offence punishable under Section 394 IPC all three have been sentenced to undergo R.I. for a period of three years. For the offence punishable under Section 3/25 of the Arms Act Vipin Pandey has been sentenced to undergo S.I. for a period of one year.

(3.) Vipin Pandey has served a sentence of 14 months, Kailash Chandra has served a sentence of 10 months and Pankaj Sharma has served a sentence of 4 months.
