JUDGEMENT

(1.) Instant appeal is directed against the order of the Ld. Single Judge impugned dt.26.09.2016.

(2.) However, office has pointed out delay of 34 days in filing the present appeal in support thereof. Separate application has been filed seeking condonation of delay u/S 5 of the Limitation Act. Although delay has been satisfactorily explained and deserved to be condoned.

(3.) It is informed to this Court that the Ld. Single Judge placed reliance on the judgment of the Apex Court in the case of Hanuman Singh Vs. The Rajasthan State Road Transport Corp., decided on 21.04.2016.
