(1.) The instant cr. leave to appeal is listed under the category of defects. The defects nos. 2, 3 and 4 are hereby over rulled.

As per facts of the case on 03.04.2013, the complainant submitted a written report at 10'O Clock in which it is specifically stated that his son Ramsu left the house in the night of 31.03.2013 for attending some marriage programme, but did not come back. Upon aforesaid information, a missing report was registered, but one Lal Singh S/o Hamji made information on mobile that in the Nalpada hills, dead body is lying. Upon said information, family members of complainant Thawara, Dharji, Kalji Prakash and Hakka went upon hill where dead body of the deceased Ramsu was found and identified by them.
(3.) Upon inspection of the dead body it is found that number of injuries were inflicted upon hands and legs so also upon head and eyes were also come out duet o injuries and head was completely damaged.
