(1.) This is the Criminal Misc. Petition under Section 482 Cr.P.C. has been filed by the petitioner being aggrieved with the order dated 15.03.2016 passed by the Special Judge SC/ST (Prevention of Atrocities) Cases, Pali (hereinafter referred to as "the revisional court"), whereby the Revision Petition No. 46/2013 filed by the present petitioner has been dismissed. The said Revision Petition was preferred by the petitioner being aggrieved with the order dated 04.03.2013 passed by the Judicial Magistrate No.2, Pali (hereinafter referred to as "the trial court"), whereby the trial court has accepted the FR No. 4/2010 arising out of the FIR/CR No. 171/2009 of Police Station Industrial Area, Pali and rejected the protest petition filed by the petitioner. This criminal misc. petition filed by the petitioner before this Court on 21.04.2016 and the Office has pointed out as many as 3 defects, however, the defects has not been removed till date.

Brief facts of the case are that the petitioner filed a complaint against the private respondents alleging that they have prepared some forged documents in relation to residential plot belonging to him and therefore they have committed offences punishable under Sections 467 , 468 , 420 120-B and 379 IPC. The said complaint was sent by the trial court to the police for investigation and police after thorough investigation has filed the negative final report on 29.03.2010, wherein it is mentioned that the allegations levelled by the petitioner in his complaint are forged.

Being aggrieved with the same the petitioner has filed the protest petition and got record the statement of him and other witnesses in support of his complain under Section 200 and 202 of Cr.P.C. The trial court after taking into consideration the conclusions of the police and the evidence produced by the petitioner in support of his complaint, has held that the dispute between the petitioner and private respondents is purely of civil nature. After observing it the trial court has accepted the final report submitted by the police.
