(1.) HEARD learned Counsel for the appellant.

(2.) THE appellant/plaintiff is aggrieved against the judgment and decree dated 26.7.2004 passed by the First Appellate Court reversing the judgment and decree of the trial Court dated 17.11.2003 and dismissed the suit of the plaintiff.

(3.) I have considered the submissions of learned Counsel for the appellant and perused the reasons given by the First Appellate Court as well as the facts of the case.
