(1.) HEARD learned counsel for both the parties.

THIS second appeal on behalf of the defendant-tenant, under Section 100 of the Code of Civil Procedure, arises out of a suit for eviction and arrears of rent filed by the plaintiff- respondent against the defendant-appellant, which has been decreed by both the courts below on the ground of denial of title as well as tenancy of plaintiff by the defendant.
(3.) BEING aggrieved with the same, an appeal was preferred by the defendant. The first appellate court, vide its judgment and decree dated 7th March, 2001, affirmed the finding of the trial Court on all the issues and dismissed the appeal of the defendant. Hence, the defendant-appellant preferred this second appeal before this Court on 27th March, 2001.
