OMPAL Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) Heard learned counsel for the applicant as well as the learned Public Prosecutor.

(2.) This bail application under Sec. 439 Crimial P.C. arises out of Criminal Case No. 15/1996 State Vs. Mukhtiyar Singh and others pending in the Court of Judicial Magistrate, Deeg for offence under Sec. 307 I.P.C.

(3.) Submission of the learned counsel for the applicant is that the applicant was on bail in the aforesaid case and he has attended dates of hearing. The applicant had gone to his relatives. Moreover, the record of the criminal case was summoned by the revisional Court. Hence, the applicant could not appear before the trial Court on 14.11.1995 on which date his bail bonds were forfeited and warrant of arrest was issued against him. In execution of warrant, the applicant has been arrested on 29.3.2007 and since then he is in jail.
