SHIV KARAN Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) Instant petition U/s. 482, Crimial P.C. has been filed assailing condition No. 2 incorporated in order dated 13.06.06 passed by Sessions Judge, Sikar while releasing Maruti Car on superdginama in favour of petitioner.

(2.) FIR-63/06 was lodged at PS Kotwali (Sikar) for offences U/Ss. 325, 366, 307 IPC. Pendente investigation, Maruti-800 Car (RJ-18-C-4996) of manufacturing year 1988 as shown in Registration certificate (Ann. 1) was seized by investigating agency.

(3.) Petitioner filed an application for release of aforesaid vehicle on superdginama U/s. 451, Crimial P.C. Learned trial Judge after taking note of material on record, allowed the application and ordered to release aforesaid Maruti Car in favour of petitioner stipulating five conditions including condition No. 2 impugned that status of sureties shall be verified by Tehsildar and other competent authority.
