JUDGEMENT

(1.) The present second appeal under Sec. 100 of the Civil Procedure Code has been filed by the defendant -appellant -tenant against the judgment and eviction decree dated 18.05.1998 passed by the learned appellate court of Additional District Judge No. 2, Bikaner in Civil Appeal No. 24/97 - Sohanlal v/s. Shri Jetha Ram, setting aside the judgment and decree dated 01.03.1997 passed by the learned trial court of Civil Judge (Junior Division) & Judicial Magistrate, Bikaner in Civil Original Suit No. 140/89 - Sohanlal v/s. Jetha Ram, dismissing the suit for eviction and recovery of rent filed by the plaintiff -respondent in respect of the suit premises, a residential house in question situated at Fad Bazar, Bikaner on the ground that the Rajasthan Premises (Control of Rent & Eviction) Act, 1950 did not apply.
