LAL CHAND Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) The instant bail application under Sec. 439 Crimial P.C. has been preferred on behalf of the petitioner who is in custody in connection with F.I.R. No.291/2015, registered at Police Station Lalgarh, District Sri Ganganagar for the offences under Sections 450 and 376(1) of the IPC.

(2.) Learned counsel for the petitioner submits that the prosecutrix is a major married woman. The manner in which, she narrated about the incident is improbable. It is a case of consensual relations which has been given colour of rape when incident came to the knowledge of the husband of the prosecutrix. Thus, he prays that the petitioner deserves to be released on bail.

(3.) Learned Public Prosecutor vehemently opposes the submissions advanced by the learned counsel for the petitioner.
