KULDEEP Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) Heard learned counsel for the parties. Perused the material available on the record.

(2.) The instant bail application under Section 439 Cr.P.C. has been preferred on behalf of the petitioner who is in custody in connection with F.I.R. No.213/2016, registered at Police Station Hanumangarh Junction for the offence under Section 19/54 of the Rajasthan Excise Act.

(3.) Learned counsel submits that the petitioner Kuldeep is the employee of the Excise Contractor Ashwini Kumar. A Naukarnama duly verified from the Excise Department to this effect has been placed on record. Learned counsel thus submits that ex -facie the possession of liquor for which the petitioner is being prosecuted in this case was lawful and therefore, there is no justification for the petitioner's prosecution in this case. He thus prays that the petitioner deserves to be released on bail.
