(1.) Heard learned counsel for the parties. Perused the material available on record.
(2.) The instant bail application under Section 439 Cr.P.C. has been filed by the petitioner who is in custody in connection with F.I.R. No.42/2015, Police Station Charbujha, District Rajsamand for offences under Sections 304B and 498A IPC.
(3.) Learned counsel for the petitioner submits that the petitioner is father -in -law of the deceased Mst.Nirma who was married to the petitioner's son 2 1/2 years prior to the incident. Mst.Nirma committed suicide by consuming poison on 30.3.2015. The statement of the father of the deceased Mangidas was recorded wherein there is no allegation that the deceased was ever harassed or humiliated for demand of dowry. He further contends that the petitioner's wife against whom there are identical allegations has been granted bail. Thus, he prays that the petitioner also deserves to be released on bail.
