VIVEK BANSAL AND ANR Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) The petitioners have preferred this misc.petition seeking directions to the respondents to conduct fair and impartial investigation taking into consideration the representation and documents submitted by the petitioners.

(2.) It is argued by counsel for the complainant as well as learned Public Prosecutor that in this case, the police has already filed challan against certain accused persons and the matter has been kept pending under Section 173(8) Cr.P.C. against other accused persons, which include the present petitioners.

(3.) It is contended by counsel for the petitioners that the petitioners have a right to submit their representation before the investigating officer and the investigating officer should consider their representation before arriving at any conclusion.
