JUDGEMENT

(1.) Present application has been filed under Section 439 Cr.P.C., 1973 for grant of a regular bail to the petitioner in a case arising out of FIR No. 110/2015, registered at police station Bhawani Mandi, District Jhalawar, for the offence under Section 8/18 NDPS Act.

(2.) The learned counsel for the petitioner submitted that from the possession of the petitioner 478 grams of opium was recovered and the said recovery is non-commercial quantity as recovery of 2.5 kg of opium constitute commercial quantity.

(3.) The learned counsel for the petitioner has stated at Bar that the petitioner is not involved in any other case.
