JUDGEMENT

(1.) The present second appeal under Sec. 100 of the Civil Procedure Code has been filed by the defendant -appellant -tenant against the judgment and decree dated 22.05.1996 passed by the learned appellate court of Civil Judge (Senior Division), Sirohi in Civil Appeal Decree No. 5/91 - Amritlal v/s. Deepchand, reversing the judgment and eviction decree dated 29.03.1990 passed by the learned trial court of Munsif & Judicial Magistrate, First Class, Shivganj in Civil Original Suit No. 25/89 - Amritlal v/s. Deepchand, dismissing the suit for eviction filed by the plaintiff -respondent in respect of the suit premises, a shop in question situated at Holi Chowk Road, Near Gol Chabutra, Shivganj.
