(1.) The petitioner has averred in the petition that he worked as teacher in the various education sessions in the Panchayat Samiti. The Government has taken a decision formulating a scheme that those who are untrained teachers and have worked in various education sessions in the Panchayat Samiti shall be regularized. The petitioner submitted his application for regularization on the strength of the evidence that he has worked in various education sessions in the Panchayat Samiti, his application was not accepted. He issued a notice for demand of justice on 17.6.2003, but the respondents did not pay any heed. He seeks a direction to the respondents for consideration of his candidature and selection as teacher.

The respondents have filed reply stating therein that scheme was formulated and as per the scheme, the applications were invited from the desirous and eligible candidates fixing 15.3.2003 as the last date for receipt of the application. The petitioner did not submit his application form till the last date and submitted a notice for demand of justice after a period of three months from the date of submission of the application. It is also stated in the reply that applications of the other candidates were received till 15.3.2003 upto 5 PM and there is no question of refusal of the application of the petitioner.

It is submitted by learned counsel for the respondent that this legal issue has been settled by the Supreme Court in the case reported in AIR 1998 SC 91 that if the application is submitted on or before the last date fixed for submission of the applications, the respondents are justified in rejecting such an application. Neither the petitioner nor his counsel is present. The petition is dismissed in default of appearance.
