LALITA SONI Vs. VIJAY KUMAR AND ANR.

JUDGEMENT

(1.) This criminal misc. petition under Sec. 482 Crimial P.C. has been filed for quashing the criminal proceedings pending in the court of Munsiff and Judicial Magistrate, Jaipur City, Jaipur in Cr. Case No. 104/1999 for offences under Sections 498-A and 406 I.P.C.

(2.) The above said criminal case was instituted by the petitioner (wife) against non-petitioner No.1 (husband) in the aforesaid trial court for offences under Sections 498-A and 406 I.PC. and challan has been filed against non-petitioner No. 1.

(3.) Thereafter, non-petitioner No. 1 (husband) Vijay Kumar filed a Divorce Petition in Family Court No.1, Jaipur against petitioner Smt. Lalita Soni (wife). In the trial court, an application under Sec. 320 I.P.C. was preferred from and on behalf of both husband and wife for dropping the criminal proceedings but the same was rejected vide order dated 20.4.2006. Hence, this misc. petition.
