JUDGEMENT

(1.) HEARD learned counsel for the petitioners and perused the petition as well as the documents placed on record. It is contended by the learned counsel for the petitioners that certain documents were produced before the Investigating Officer but he is not taking the same on record and as per those documents no offence is made out against the petitioners.

(2.) OBVIOUSLY, the Investigating Officer is required to act fairly and conduct the investigation in accordance with the law and if any document is produced before the him, in connection with any FIR, then, he is required to take on record and examine the same. Accordingly, in the interest of justice, it is expected from the Investigating Officer that if the petitioners file certain documents with regard to his innocence, then, the Investigating Officer shall take on record those documents and examine the same in accordance with the law. With the aforesaid observations, the petition is disposed of.
