JUDGEMENT

(1.) Heard the learned counsel for the petitioner and learned Public Prosecutor for the State and perused the order impugned.

(2.) The contention of the learned counsel for the petitioner is that in the instant case evidence has been recorded and the matter is fixed for recording statement of accused under Sec. 313 Crimial P.C. In the court of Additional Sessions Judge, Sangariya, bearing Sessions Case No. 4/05 (State Vs. Pala Singh). According to the learned counsel for the petitioner, accused petitioner is in jail since 11.11.04 and the Court of Additional Sessions Judge, Sangariya, is lying vacant from 27.5.05, therefore, his case may be transferred to any other court in Hanumangarh District.

(3.) Learned Public Prosecutor has opposed the application.
