(1.) This petition was filed in 1990 alleging absence of proper drainage and sewerage facility in the residential locality of Bank Colony, Near Raikabagh, Jodhpur. At the earlier stage of litigation, the Court has noticed lack of coordination in discharging of civic obligation to citizens between concerned authorities and trying to shift responsibilities on each other's shoulder by pointing out the responsibility of the other civic body for maintaining proper sewerage and drainage system. That led to making of order dated 21.11.2002 requiring the Commissioner, Jodhpur to coordinate functioning of the various authorities to provide such amenities in the area. The citizens are not concerned with how power distribution is amongst the various state authorities, in the matter of maintaining civic facilities in any town.

Be that as it may, it is pointed out by the learned counsel for the respondents that since another petition was filed one Prithvi Raj Singh in respect of very same relief and that has been disposed of earlier. In pursuance of directions contained in said petitio9n, drainage sewerage lines have been laid. However, it has given rise to new problem by reason of damaged roads and broken water supply lines. In the aforesaid circumstances the pleadings of this petition have become inapt for seeking any relief in relation to new problems.
(3.) For considering other problems arising subsequently, the foundation has not been laid in the petition. Accordingly, this petition is disposed of without making any directions in view of the directions already given in Prithvi Raj Singh's case. For any other problem, the petitioner or any other who may have concern, is at liberty to move afresh by placing before the Court the existing scenario for seeking appropriate direction.
