JUDGEMENT

(1.) Heard learned counsel for the parties.

(2.) The plaintiff-respondents filed a suit for declaration and permanent injunction in the Lower Court, which was dismissed, but on an appeal filed on behalf of the plaintiffs, the First Appellate Court set aside the judgment and decree passed by the Lower Court and decreed the suit of the plaintiff-respondents.

(3.) Controversial issues involved in the present case are relating to the question of facts and there is a finding of fact recorded by the First Appellate Court in this regard, which cannot be interfered with by this Court in second appeal under Section 100 of the Civil Procedure Code.
