JUDGEMENT

(1.) Heard learned counsel for the applicant-appellants and public prosecutor for the State on application seeking suspension of sentence. Perused the judgment and order impugned and record of the trial court.

(2.) The allegation against the present applicantappellants is that they committed dacoity in the night. Both the applicants were put to identification test in the presence of Judicial Magistrate. PW-6 Ramesh Goswami had rightly identified both the applicants which has already been established from the evidence of PW-14 Amit Sahlot who conducted the identification test.

(3.) Keeping in view, the serious allegation and the fact that both the applicants were identified by the witnesses, I do not find it a fit case to suspend the sentence awarded to the applicants.
