MOHAMMAD RAFIQUE Vs. STATE OF RAJASATHAN

Decided On May 29, 2006
MOHAMMAD RAFIQUE Appellant
V/S
STATE OF RAJASTHAN Respondents

JUDGEMENT

(1.) By the instant bail application under Section 389 Cr.P.C., the applicant-appellant seeks temporary suspension of sentence on the ground of marriage of his brother.

(2.) Heard learned counsel for the applicant-appellant and public prosecutor for the State assisted by counsel for the complainant. Earlier, the sentence awarded to the applicantappellant was suspended as many as on three occasions. It appears that it is a design by the applicant-appellant to seek temporary suspension of sentence on one ground or the other.

(3.) The ground on which the temporary suspension of sentence is sought is marriage of his brother which can be solemnized in absence of the applicant-appellant. In the circumstances, therefore, I do not find it a fit case to suspend the sentence even temporarily. The bail application seeking temporary suspension of sentence is therefore, dismissed.
