JUDGEMENT

(1.) Heard learned counsel for the petitioner as no one appeared for the respondent despite service even in second round.

(2.) The petitioner, wife of the respondent, submitted application for transfer of divorce petition filed by respondent and which is pending in the Court at Bikaner on the ground that the petitioner has been turned out of the house by the respondent and she has two daughters and she is living at Jodhpur with her parents. She cannot travel to the Court at Bikaner which is at a distance of more than 200 kms. from Jodhpur. The petitioner's daughters are also studying at Jodhpur. The petitioner also levelled allegations against the respondent and she apprehends her insecurity from the respondent.

(3.) In view of the facts mentioned above, this transfer application is allowed, the divorce petition no.14/2005 (Kishore Kumar vs. Smt. Anita) pending in the Court of Additional District Judge no.1, Bikaner is hereby withdrawn and is transferred to the Family Court, Jodhpur for deciding the same in accordance with law.
