JUDGEMENT

(1.) By way of filing the present criminal misc. petition under Sec. 528 BNSS, the petitioner has prayed for the following reliefs:--

As per the prosecution, the complainant Bhagaram submitted a written report before the SHO of Police Station Sayla alleging inter alia that on 8/2/2025, when he was returning home on his motorcycle after attending a fair at Juna Gala Tura, suddenly he was intercepted by Galba Ram and co-accused persons. The petitioner Galba Ram and co-accused persons kidnapped him, forcibly made him drink alcohol, beaten him and used castiest slurs against him. They also stole cash amounting to Rs.5,000.00 and two mobile phones held by the complainant. Thereafter, the petitioner and co-accused persons threw him inside a cowshed located in Borwada and went away. On these facts, FIR No. 33/2025 was lodged at Police Station Sayla, District Jalore for the offences under Ss. 126(2), 115(2), 140(3), 303(2) and 3(5) of BNS and Ss. 3(1)(r), 3(1)(s) and 3(2)(vi) of SC/ST Act.
