JUDGEMENT

(1.) Heard the learned counsel for the parties.

(2.) The application of the petitioner was rejected by the respondents vide order dated 26.5.2014 on the ground that as per the departmental order dated 2.2.2006 the petitioner was of 17 years of age on the date of death of his father, therefore, not entitled for appointment because while exercising power under Rule 39 of the Rajasthan Cooperative Societies Rules, 2003, the necessary instructions were issued by the Registrar Cooperative Societies, Jaipur on 16.7.2010 whereby it is provided that in the event of filing application by the minor, his case should not be kept pending till he attains the age of majority.

(3.) The learned counsel for the bank submits that bank is duty bound to comply the order dated 16.7.2010, therefore, the prayer of the petitioner cannot be accepted to provide appointment on compassionate ground.
