JUDGEMENT

(1.) HARI Ram, his three sons, namely Jagdish, Ram Singh and Tara Chand, his wife Ganga Devi and two daughers, namely Santra and Moti, were sent for trial in a case arising out of FIR No. 246/03 dated 6.9.2003, registered at the Police Station Rajgarh, for the offences under Sections 147, 148, 149, 323, 341 and 307 IPC.

(2.) ACQUITTAL of three ladies, namely Ganga Devi, Santra and Moti was made subject matter of challenge in D.B. Criminal Leave to Appeal No. 194/2014 and S.B. Criminal Revision Petition No. 900/2014. The aforesaid criminal leave to appeal was dismissed vide order dated 10.11.2014 by a Division Bench of this Court, of which one of us (Kanwaljit Singh Ahluwalia, J.) was a member. Vide a separate order of even date, we have also dismissed the S.B. Criminal Revision Petition No. 900/2014 filed by the complainant assailing the acquittal of acquitted ladies.

(3.) D .B. Criminal Appeal No. 1413/2007 has been preferred by Hari Ram and his two sons, namely Jagdish and Ram Singh. Tara Chand was earlier declared juvenile, but subsequently, Juvenile Justice Board came to the conclusion that Tara Chand on the date of occurrence was not a juvenile and thus, he was separately tried. Tara Chand has filed a separate appeal i.e. D.B. Criminal Appeal No. 794/2014. We shall decide the said appeal separately, as a separate judgment has been passed against Tara Chand.
