JUDGEMENT

(1.) PRESENT appeal has been preferred by five appellants namely Ram Sawroop, Ramphool both sons of Hazari, Manohar @ Mandor, and Ramesh both sons of Mishariya, and Mishariya s/o Shri Kishan.

(2.) APPELLANT Manohar @ Mandor was substantively convicted for offence under Section 302 IPC, for having caused murder of Kailash, whereas remaining accused -appellants were convicted with aid of Section 149 IPC. Ramesh son of Mishariya was substantively convicted for offence under Section 323 IPC, whereas remaining accused were convicted for offence under Section 323 readwith Section 149 IPC. The appellants were also convicted, and sentenced for offence under Section 148 IPC.
