JUDGEMENT

(1.) The present Bail Application has been filed under Sec. 439 Crimial P.C. on behalf of the petitioner, who is in custody in connection with F.I.R. No. 321/2015, Police Station Bhimganjmandi, Kota City for the offences under Sections 376 and 420 I.P.C.

(2.) Heard learned Counsel for the petitioner and the learned Public Prosecutor and perused the material available on record.

(3.) Learned Counsel for the petitioner contends that prosecutrix is a major married woman. She and the accused were carrying on physical relations for last more than 3 years. Finally in Oct., 2014, the relations fell out owing to some monetary dispute and thereafter the belated F.I.R. was lodged against the petitioner. Investigation is complete and charge-sheet has been filed. He prays that the accused deserves to be enlarged on bail.
